Dispute Resolution
Dispute resolution tools
Our lawyers are experts in forms of dispute resolution, and will recommend the best process for your situation. The following are some of the tools at our disposal:
- Negotiation
Most disputes and claims are best resolved early. We will work to negotiate the best settlement for you, usually without it ever going to court. We are acknowledged as skilled and experienced negotiators — being as tough or conciliatory as the circumstances require. - Mediation
Sometimes no amount of negotiation alone will resolve the dispute. Traditionally, the only choices have been litigation or arbitration — but these can be expensive and time-consuming. Litigation may also bring unwelcome publicity.
Mediation is a way of settling disputes and claims using a neutral, third party. It is successful in more than 80% of cases. We are strong supporters of mediation as a way of obtaining commercial settlements, and are renowned for being highly successful at resolving disputes and claims by mediation. - Arbitration
Arbitration is an alternative to litigation, especially for international disputes. It will normally be cheaper and quicker than court proceedings. We have expertise in both UK and international arbitrations. - Litigation
Litigation is the heavy weaponry of the dispute resolution process. We have represented clients in difficult and high-profile cases. All our senior lawyers are solicitor-advocates, and manage the litigation process in a comprehensive and cost-effective manner.
Some of the specialist processes which are available to you are: - search orders & freezing injunctions
… to prevent a defendant from destroying crucial evidence or removing money and assets out of the UK to avoid paying a judgment - interim & final injunctions
… to protect your rights when your business is being threatened - appeals & judicial reviews
… to contest unsatisfactory actions and judgments up to the House of Lords and the European Court of Justice and Human Rights
