Financial Regulatory Reform since the Credit Crunch

Following the credit crunch and G20 Accord, we are witnessing the promulgation of wholesale changes to financial regulation on both sides of the Atlantic comparable only to the introduction of US Securities laws after the Wall Street Crash of 1929.

In the US, the Dodd Frank Act has implemented many of the G20’s recommendations. In the EU, the G20 Accord and Basel Committee recommendations are being implemented by MiFID II, MiFIR, EMIR, the Market Abuse Directive, REMIT and the Capital Requirements Directives, as well as by other initiatives following on from the above, such as the Remuneration Code and Senior Managers Regime. This follows the already major changes instituted by the original Markets in Financial Instruments Directive (or MiFID I) in 2007.

The winds of change in the regulatory landscape have created challenges and opportunities for businesses operating in the financial and commodity markets. Whether you are a seasoned regulated business or to date have been lightly or even unregulated, your regulatory obligations are likely to increase and change.

How Fox Williams can help

Lawyers at Fox Williams have hands-on experience of helping financial institutions prepare for implementation and compliance with these new laws and regulations. This may include amending and updating your terms of business, preparing platform rulebooks for multilateral or organised trading facilities or advising you on the strategic shape of your business ahead of a major regulatory shift. Additionally, we can help you comply with the new Senior Managers Regime and the latest version of the Remuneration Codes.
