Brexit has had an important impact on the protection of fashion trade marks and designs and has created uncertainty.

Trade mark rights are now treated differently and a brand owner may now be able to prevent the re-sale of items in the EU that are first marketed in the UK.

Meanwhile new UK fashion designs may no longer be protected in the EU and new EU designs may not be protected in the UK.
