Ed Livingstone and Grace Waterhouse report on two recent employment tribunal cases arising from the pandemic and examine the lessons for employers It seems inevitable that, as in Montanaro, tribunals will consider Covid-19 to present circumstances of danger under the Employment Rights Act. This means that employees are likely to be protected from dismissal if they are taking steps to protect themselves or others from coronavirus.
