In our second HRLaw webinar of 2025, hosted on Thursday 26 June, we discussed the latest immigration and employment law issues and grappled with their practical implications.  

Key topics of discussion:

  • Immigration update for employers and sponsor holders. Our immigration partner, Sacha Schoenfeld, provided an overview of  need-to-know considerations in light of the ever-changing immigration landscape, looking at the changes outlined in the recent immigration White Paper, examining the effect of the Government’s recent proposals.  She explored the implications for sponsors, employers and employees, including the shift to an ‘earned settlement’ model and the potential increase to the number of years required for UK permanent residence, changes to sponsored work routes and skills levels for employees of UK companies, as well as potential changes to the rules relating to applications for British citizenship – all of which could have profound implications to employers as well as employees in the UK.
  • A briefing for employers on the new corporate criminal offence of “failure to prevent fraud” offence, which comes into force on 1 September 2025 (including the type of “reasonable fraud prevention measures” that will be required and the potential consequences failing to implement these).
  • Addressing the EHRC guidance for employers following the For Women Scotland Ltd Supreme Court ruling on the definition of a “woman” under the Equality Act 2010. Together with an overview of the EHRC consultation document and the status of the legal challenges made against the Supreme Court ruling and EHRC guidance.
